About These TermsThese Terms of Service govern your use of the website at www.thebraininjurytherapist.co.uk and any associated digital tools, apps or services provided by The Brain Injury Therapist ("we", "us", "our"), the trading name of Natalie Mackenzie, operating as part of THE BIS SERVICES LIMITED.By using our website or services, you agree to these terms. If you do not agree, please do not use our services.2. Our ServicesThe Brain Injury Therapist provides:• Online cognitive rehabilitation and fatigue management services• Bespoke digital rehabilitation apps for symptom and activity tracking• Educational content, resources and programmes relating to brain injury and cognitive health• Integration with third-party wearable devices (with your explicit consent)Our services are provided by a qualified Cognitive Rehabilitation Therapist and are intended to complement, not replace, medical treatment. We are not a medical emergency service. If you are experiencing a medical emergency, contact 999 or attend your nearest A&E.3. Clinical and Health DisclaimerThe information and tools we provide are for rehabilitation support purposes and are based on current evidence and clinical expertise. They do not constitute medical advice and should not be used as a substitute for professional medical diagnosis or treatment.Progress in rehabilitation varies between individuals. We do not guarantee specific outcomes. We will always work in your best interests but cannot be held responsible for outcomes that arise from factors outside our control, including non-engagement with the programme, changes in your health, or decisions made independently of clinical advice.4. Digital Apps and ToolsWhere we provide you with access to a bespoke digital rehabilitation app:• The app is provided for your personal rehabilitation use only and must not be shared with others• You are responsible for the accuracy of data you enter into the app• We will use your app data to inform your clinical programme as described in our Privacy Policy• Access to the app is provided as part of your clinical engagement with us and may be withdrawn if that engagement ends• The app is provided in good faith. We will endeavour to fix technical issues promptly but cannot guarantee uninterrupted availability5. Wearable Device IntegrationsWhere you choose to connect a wearable device (such as the Oura Ring) to your rehabilitation app:• You authorise us to access specified data from your device account via the device manufacturer's secure authentication process• You may revoke this access at any time through your device account settings• We process this data in accordance with our Privacy Policy• We are not affiliated with, endorsed by, or responsible for the products or services of third-party device manufacturers6. Fees and PaymentFees for our services are agreed in advance and set out in your service agreement or client contract. Fees are payable in accordance with the terms of that agreement.We reserve the right to amend our fees with reasonable notice. Where fees are funded by a third party (such as a case manager or insurer), the terms of that arrangement take precedence for payment purposes.7. Intellectual PropertyAll content on our website and within our digital tools — including text, frameworks, methods, graphics, and the C.O.G.S. Method — is the intellectual property of Natalie Mackenzie and THE BIS SERVICES LIMITED unless otherwise stated.You may not reproduce, distribute or use our content for commercial purposes without our written permission. Personal use for the purpose of your rehabilitation programme is permitted.8. ConfidentialityWe treat all client information as strictly confidential in accordance with our professional obligations, GDPR, and our Privacy Policy. We will not disclose your information to third parties without your consent, except where required by law or where there is a risk of serious harm to you or others.Where we work within a multi-disciplinary team at your request, relevant clinical information may be shared with other professionals involved in your care.9. Limitation of LiabilityTo the fullest extent permitted by law, our liability to you in connection with our services is limited to the fees paid by you in the three months preceding any claim.We are not liable for any indirect, consequential or special losses arising from your use of our services or digital tools, including loss of data, loss of income, or any outcomes arising from technical failures of third-party platforms.Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.10. Governing LawThese terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.11. Changes to These TermsWe may update these terms from time to time. Where changes are material, we will notify you by email. Continued use of our services following notification constitutes acceptance of the updated terms.12.
